A guy, Duncan Simfukwe Bulwell Paedophile, who sought to initiate sexual conversations with a minor has been issued a court order imposing behavioural restrictions for a duration of 10 years.
Duncan Simfukwe, 35 years old, was apprehended following allegations that he transmitted sexually explicit texts to an individual he presumed to be a 14-year-old girl.
Nottingham Crown Court was informed that he had engaged with a fake account established by an online child advocacy organisation.
The group notified the police, resulting in his arrest on the same day.
Investigators confiscated his mobile devices and uncovered sexually explicit messages directed at the fake account, including one instructing the alleged girl to refrain from informing her parents about their communications.
Duncan Simfukwe, previously residing on Northolme Avenue in Bulwell, was subsequently charged with attempting to engage in sexual communication with a minor.
Duncan Simfukwe first entered a plea of not guilty, saying that he believed the individual he was communicating with was “toying with him” and “merely engaging in games” when they asserted they were 14 years old.
The matter was progressing towards trial when he altered his plea to guilty during a hearing in October.
During his sentencing hearing on Wednesday, February 5, he received a 10-month prison sentence, suspended for two years, was registered as a sex offender eternally, and was subjected to a Sexual Harm Prevention Order for 10 years.
Such orders constrain an individual’s conduct to avert the commission of additional sexual offences.
In Duncan Simfukwe’s case, the order forbids him from holding any photograph of a female kid under 16 years of age, unless he has the consent of the girl’s parent or guardian.
He is prohibited from initiating contact with or engaging in any employment that may lead to unsupervised interaction with vulnerable individuals under the age of 18.
He is additionally barred from holding any computer software, program, or storage medium that contains photos of any female child under the age of 16 years, unless authorised by the child’s parent or guardian.
Duncan Simfukwe risks incarceration if he violates the injunction.
Following the hearing, Detective Constable Charlotte Read, who led the investigation, said:
“The safeguarding of children and young people is a priority for Nottinghamshire Police and that is why we responded positively to information provided to us by the online child sexual abuse activist group.
“Duncan Simfukwe was quickly arrested and I am pleased the court has put strict measures in place in order to restrict his behaviour.
“I also hope that this case will alert others to the dangers of the digital world – Duncan Simfukwe used a popular social media app to communicate with the decoy account, but there are many other ways that children communicate online today and we urge parents to remain vigilant and seek support if something doesn’t seem right.”
