Michael Stephenson, the prosecutor, claimed Jay Ferguson’s phone showed he had visited two “female-only dating websites”: Zoe and Only Women.

Liverpool Crown Court also heard he broke the rules by contacting his adult niece via Facebook Messenger.

When prosecutors unveiled the letters “indicating his intention to carry out a violent rape on his release” by utilising Tinder, Jay Ferguson was found guilty of possessing an obscene photograph and carrying a blade in January 2020.

Concerning a letter written on February 6, 2020, he was found guilty in August 2020 of malicious communications.

Mr Stephenson claimed it involved threats to a female officer at Styal “to track them and tie them down and attack them with a rape kit”.

Jay Ferguson received a two-year restraining order prohibiting him from Styal and from contacting his victim.

Defending Gerald Baxter claimed the breaches caused “little or no harm or distress” as Ferguson had discussed money with his niece and had not contacted anyone or set a date on the apps.

He said: “He had a challenging upbringing. Personality disorder has a historical background.

Mr Baxter asked the court to spare him jail and mentioned a hostel in Birmingham, from whence Jay Ferguson initially came, with a “strict regime” involving a curfew.

Treatment would be accessible, “which the defendant is anxious to take advantage of,” he said, particularly for drug and alcohol abuse.

Jay Ferguson also intended to refer himself to a local hospital for mental health care, the attorney added.

Judge David Potter questioned how he could “square” that with a psychological examination and pre-sentence report pointing out hazards.

Mr Baxter said, “Perhaps there is a real prospect that the risk might be reduced” if Ferguson sought the treatment.

Judge Potter claimed that two days after his release from prison, he deliberately and flagrantly broke the SHPO twice.

He underlined Jay Ferguson’s criminal record, earlier admissions on his intents and “rape threats towards a female prison officer”.

The court said that the probation service judged Jay Ferguson as having a “very high risk” of reconviction and causing significant damage.

Judge Potter mentioned he also came under “multi-agency public protection arrangements”.

“They assess you as a very high risk of causing serious harm to children, the public and staff that you come into contact with,” he said.

The court remarked, “I accept you have made some efforts to tackle some of the underlying issues in your psychological make-up.”

However, he also observed Jay Ferguson’s actions following his earlier residence at Adelaide House in Kensington.

Judge Potter stated, jailing him for only ten months: “The court has sadly no confidence that you, whether in approved premises or not, will not commit further breaches.”
