A case concerning sexual offences against a minor by Juan Alameda, the Immokalee Pedophile, has led to a conviction, facilitated by the admission of pivotal evidence, following a legislative amendment sponsored by Florida State Representative Jenna Persons-Mulicka and Florida State Senator Jonathan Martin, and enacted by Governor Ron DeSantis.
The amendment to the statute resulted in the conviction of Juan Alameda from Immokalee for Familial or Custodial Sexual Battery and Lewd or Lascivious Molestation. The criminal repeatedly sexually assaulted a minor. The facts pertinent to this case prompted State Attorney Amira Fox’s staff to propose a modification to the legislation to incorporate this significant evidence.
Assistant State Attorneys Laura Mason and Mara Marzano prosecuted the case against Juan Alameda throughout a three-day trial in Collier County. The jury rendered a guilty decision shortly after 7 p.m. on Friday.
The main evidence in this case was an audio recording of the defendant during the perpetration of the crime. A guardian of the minor victim harboured misgivings regarding the defendant, who had made a troubling remark about the child. The guardian subsequently placed the child’s cell phone inside a dollhouse situated in the living room of the property to document any interactions between the defendant and the child. The following morning, the guardian examined the phone and perceived what appeared to be a crime in progress. They promptly notified the Collier County Sheriff’s Office.
State Representative Persons-Mulicka and State Senator Martin sponsored House Bill 934.03, which was enacted by Governor DeSantis in April 2024. Florida Statute 934.03 stipulates that a parent or legal guardian of a child under 18 years may lawfully intercept and record an oral communication if the child is a participant in the communication and the parent or guardian has reasonable grounds to believe that the recording will capture a statement from another party regarding an intended, ongoing, or completed unlawful sexual act or an unlawful act of physical force or violence against the child.
“Prior to this new law, this recording would not have been admissible in court. This law is largely responsible for this important conviction as is the commendable work of the prosecutors in this case who dedicated many hours and used their legal expertise to navigate other challenges such as not having the guardian or victim participating in the case,” said State Attorney Fox.
“I also want to express gratitude to Governor DeSantis for signing the bill into law following the work of Representative Persons-Mulicka and Senator Martin. This law is already having a crucial impact on keeping Florida safe from predators,” said State Attorney Fox.
Sentencing is scheduled for June 4, 2025. The State is seeking life in prison.
