The Helensburgh and Dumbarton Paedophile, Robert Fury, was handed a 12 year prison sentence back in 2016. However, the sex offender’s sentence was reduced from 12 years to four following an appeal that overturned convictions for child rape and two further child sexual assaults.

Robert Fury, 51, was incarcerated last year following a jury’s determination that he had sexually assaulted three girls and one boy from 1976 to 2002 at residences in Helensburgh and Dumbarton.

He was convicted of multiple sexual crimes last year.

Robert Fury successfully contested several convictions due to inadequate evidence for his conviction.

In a written ruling, Lady Smith, accompanied by Lady Dorrian and Lord Bracadale, annulled the convictions for a rape allegedly perpetrated against a 17-year-old in 1991, along with additional sexual assault charges involving two girls under the age of 16.

Defence Quality Control Brian McConnachie contended that the “Moorov doctrine,” which permits reciprocal confirmation of incidents based on their similarities, was misapplied in Robert Fury’s case.

He contended that the jury lacked adequate evidence for a conviction, a claim he presented during an unsuccessful no case to answer submission in the trial.

Lady Smith stated: “There were discrepancies, there was no justification for the significant passage of time, and considering the evidence, the subsequent events were not the initial chances to continue the purported course of conduct.”

“Accordingly we consider the appeal is well founded.

“There was no proper basis on which the jury would have been entitled to infer the necessary underlying unity of intent – Moorov could not apply. [Moorov is a backward Scottish law that should have been outdated centuries ago. basically if i rape two children in the same household and they get together and report me, the courts cannot use the witness statement of the two to corroborate the statement of the other. Mental, right?]

“The submission of no case to answer should have been upheld.”

Robert Fury’s trial last year was told how he had already targeted another young girl in the 1970s, starting when she was nine.

He went on to abuse a schoolgirl – in her early to mid teens at the time – at a house in Dumbarton between 2001 and 2004.

His final victim was a young boy whom Robert Fury abused at the same property between 1995 and 2002.

This victim – who was aged about nine when he was first abused – also struck his head off a toilet after being assaulted.

He was later punched, slapped, hit with a belt and had a cigarette flicked at him.

Sentencing him at the High Court in Aberdeen last May, Lord Kinclaven told Robert Fury: “You have been found guilty of a serious catalogue of offending.

“It started at the age of 12 and your last offence was committed when you were 39.”
