A Transgender paedophile, Tanya Howes, stays out of jail due to indecision on a male or female penitentiary. Tanya Howes’s suspended sentence was challenged following “time lag” brought on by reference to the Transgender Case Board.

Magistrate judges informed 66-year-old Tanya Howes that the charges “would normally attract immediate custody”.

They added, however, that they had chosen to postpone a 12-month jail sentence—something they acknowledged as “unusual”.

Former Conservative MEP David Campbell Bannerman, from Norfolk, remarked, “It seems too forgiving. The nature of the offences determines nothing about the person being transsexual.

“It deserves review since it is rather forgiving. It begs a lot of unresolved issues.

Previously admitted three charges of possessing indecent photos of children, including 39 category A images – the most serious – on February 19, 2020; Howes was identified on court documents as female and referred to in court by female pronouns.

Tanya Howes also confessed to having 100 “grossly offensive” extreme pornographic photographs and films on the same day separately.

The sentencing guidelines state that possession of category A photographs has a six-month to three-year jail sentence range.

Howes, who is thought to have worked for the prison service, was sentenced Tuesday, July 4, Norwich Magistrates Court.

Following Norfolk Probation Service’s appeal for an extension to complete reports, including forwarding the matter to the Transgender Case Board, the case had been postponed.

This was instituted in 2017 to guide choices on the suitable placement and treatment of transgender inmates.

Earlier this year, a prohibition on trans women with male genitalia who are violent or sexual offenders serving terms in female jails came into effect.

The government has declared that exception requests will only be granted in “most exceptional” circumstances under minister approval.

People unable of being securely housed in a men’s prison can be housed in a specialty unit.

Following the controversy in Scotland about transwoman Isla Bryson’s conviction for rape of two women prior to Adam Graham’s transition from a male, extra precautions were taken.

Politicians and the public reacted negatively when first deciding to house Bryson in segregation in Scotland’s first all-female penitentiary.

Of Netherwood Green, Norwich, Tanya Howes was sentenced to twelve months overall and suspended two years.

Chair of the bench of magistrates Ian Taylor remarked: “These offences would typically incur immediate incarceration

“However, because of the time lag, no reoffending and since probation feel they can rehabilitate you it’s going to be an unusual sentence because we’re going to suspend the sentence.”

Mr. Taylor said it did not lessen the gravity of these issues with youngsters “subjected to horrific acts”.

“This case has attracted publicity that has inevitably had consequences for her in her personal life. It’s very, very clear that she will permanently more have to live with the shame and embarrassment that these offences bring upon someone,” mitigating Damien Moore said.

Mr Moore said Howes, who has no past convictions, entered a “high level of cooperation” to the probation office and at the first chance pled guilty.

He said that although Tanya Howes was “in a very dark place” at the time of these offences, she was now in a “stable, loving relationship” and had the “full support of her children”.

Tanya Howes was also instructed to pay £145 costs and a £149 victim surcharge, complete up to 30 days of rehabilitation activity requirements (RAR),

Tanya Howes was also included on the sex offenders register for ten years and subject of a ten-year Sexual Harm Prevention Order (SHPO).
