What are the different categories of images when prosecuting a paedophile, sex offender and child molester?
Paedophiles or child molesters seem to collect images of varying categories. We will look at what categories A, B, and C indecent images consist of, with a description and example of each. When we read about the different categories, it is easy to flippantly dismiss them.
Category A
Indecent images involving penetrative sexual activity, sexual activity with an animal or sadism.
In either instance, this would entail the victim’s penile penetration of the mouth and penetration of the anus or vagina utilising body or object. It is not suggested that a difference exists between penetrative activity between an adult and a child and between children themselves.
Although the sentencing policies a UK lawyer would advise that for simple possession of photos, an immediate jail sentence is improbable, the most likely sentence would be a community order or suspended term. Unless your case involves the production or distribution of category A photographs, a UK lawyer would advise that solid legal advice and case preparation allow a suspended sentence to be achieved.
Examples of Category A images:
- A penetrative act of a child’s anus or vagina with either a body part or other object.
- An act of penetrative or oral intercourse performed by a child on an animal.
- An act of penetrative or oral intercourse performed on an animal in the presence of a child.
- An act of non-penetrative or oral intercourse performed by an animal on a child.
Some of the images or videos that are found in a paedophile’s possession for a category A offence could be:
- Adult male forcing penis in and out baby’s mouth with baby crying and gasping for breath in between
- Toddler (would be in nappies) picked up and placed into an erect seated male with toddlers screaming and crying
- Eight-year girl old tied by wrists and ankles to a bed whilst being raped by an adult male
- A six-year-old boy was lying on the front of the bed for a video of an adult male raping him
- Video of an adult make slowly breaking four-year-old fingers before raping them
- Video of an adult male slowly breaking a ten-year-olds arm before raping him anally whilst the child tries to protect his broken arm
- Images of dogs raping children of all ages, usually in “doggy style.”
- Images of children licking or giving oral to animals
- Video of 10-year-old performing forced rape on an animal
- Rape of a smaller animal, e.g. cat, chicken, etc., in front of a child, ends with the animal dying of horrific internal injuries
- Female paedophiles rape children anally and vaginally with “sex toys.”
Other category A images or videos will include the death of a baby or a child. For example:
- Babies get brought into the ER with catastrophic internal injuries, and the mother says the baby was dropped by accident. The hospital discovers the insides of the baby have been damaged beyond belief, with a broken spine, ruptured organs, etc. They then realise that someone has raped the baby to death.
- Another relatively “common” baby injury is a fractured skull, as when the male ejaculates, his total body weight falls onto the baby.
- More common are toddlers and young children who die whilst being raped and tortured. They do not have the constitution that an adult does, so it is sometimes intentional but mostly seen as collateral damage.
So the next time you read category A, just remember what these innocent-looking paedophiles are doing.
Category B
Images involving non-penetrative sexual activity
Mutual masturbation is one of the non-penetrative sexual assaults. Generally speaking, this definition entails the presence of an adult. Pictures of graphic sexual behaviour typically show a child engaged in sexual activities devoid of an adult present. This would cover representations of masturbation, among other behaviours.
Examples of Category B images
- The performance of a sexual act, intercourse or oral, with or in the presence of a child.
- A sexual act such as masturbation involving a child or in the presence of a child.
- A penetrative act performed in the presence of a child.
Some of the images or videos that are found in a paedophile’s possession for a category B offence could be:
- Video of two young girls kissing whilst an adult male ejaculates on their hair
- Adult males masturbating and ejaculating on any part of a child’s body
- Female paedophile sexually molesting a child without any penetration
- Two adults having sex in front of a child
- Video of a woman giving a man oral sex with the woman making the man ejaculate on the child watching
- A child performing oral sex on a female paedophile
Category C
Indecent images do not fall into categories A or B.
Category C images show some overtly provocative material. Category C images might include everything from family photos to commercially released images. Since specific photos might not be sexual, the jury’s objective assessment helps them to determine if an image is obscene.
Examples of Category C images
- Sexually suggestive family images
- Images that are digitally created (e.g. cartoons, anime, etc) to look like sexual acts carried out between children and children or adults or animals
- Images potentially deemed indecent to a jury.
Some of the images or videos that are found in a paedophile’s possession for a category C offence could be:
- Well-known cartoons re-done to feature the adults or animals performing sex acts with the children or animals in the shows
- Anime of various types showing sex between aliens and children, humans and children, etc
- A child standing naked apart from bows on their wrists and ankles in a photograph
- Naked images of children in “normal” but unusual poses
- A family picture with the father seemingly touching or holding the child in a suggestive manner
After the category of images has been decided upon, the prosecutors then need to determine if the paedophile is guilty of
- Possession of indecent images: Legal prohibition forbids the physical or digital ownership of an obscene image.
- Making indecent photographs is handled very much like possession cases. It includes viewing an image, which subsequently results in the image being downloaded to the device on which it is viewed. Making is sometimes misinterpreted, not indicating that someone created or acquired the original image. Indecent image creation can take many forms, usually resulting from someone downloading them from the internet. Downloading “makes” the indecent image on the device upon which it has been downloaded. However, the “making” of the image can also occur automatically, occasionally when a gadget hits a web website and shows offensive photos of youngsters. This is a particularly complicated area of the law. Thus, a thorough knowledge of the technology underlying this is essential to guarantee that the correct counsel and tactical approach is used.
- Often involving the transmission or sharing of a digital file, for example, by social media, email, in a chat room or file sharing programme, the distribution of obscene photographs involves It has to be proven that the individual purposefully shared the picture and that he did it to transmit an offensive image. Regarding the later part, the prosecution has to prove that the sender knew the picture was offensive.
- Making indecent photos is not the same as producing indecent images. Usually involving the actual shooting of a picture or production of a video or film, production cases would allow the accused individual to record or use the camera to generate obscene content.
Conclusion
I hated writing that. I felt angry throughout, and if anyone is still thinking that these images/videos aren’t as bad as the above, then do the following (don’t worry, it isn’t illegal until you actively join a site or download an image/video):
- Sign up for a free VPN
- Download TOR browser
- Turn on the free VPN
- Open your TOR browser
- Go to a search site like TOR66.onion
- Click on the obscure ads at the bottom of the search engine
- Stare in disbelief at the montage you are seeing whilst your brain tries to make sense of it
- Barter, remember that what you see must be photoshopped, or the children must be young adults, please!
- Realise what you are seeing is the “nicer” images and is what it is
- Close TOR, uninstall it and the VPN
- Spend a week trying to make sense of what you saw and a lifetime of remembering the images.
